On Monday, April 4, 2022, Georgia legislators ended the forty (40) day legislative session. With the end of the session comes a laundry list of new bills for Governor Kemp to review and either sign or veto May 14, 2022.
Pertinent to family law, Senate Bill 576 revises language in the Official Code of Georgia Annotated dealing with grandparent visitation. Pursuant to S.B. 576, the trial court would be required to apply a clear and convincing standard of review when determining grandparent visitation over the objection of a fit parent. This distinction would only occur when a child’s parent dies, is incarcerated, or is incapacitated. Should this bill be signed by Governor Kemp, the same would be codified at O.C.G.A. 19-7-3(d) as a revision to the current statute.
We will have to wait and see to see how this plays out for Georgia’s grandparents.
