Grandparents Becoming Second Parents: Know Your Rights

The parenting landscape has been steadily changing over the years as more and more grandparents are becoming parents to their grandchildren.  Whether the same is due to more and more children being born out-of-wedlock, or because divorce is on the rise and family units are broken up, grandparents have been gaining more prominent roles in what our current generation sees as a nuclear family.

With grandparents taking on the role of parents, the time has come for grandparents to know their rights and seek legal courses to protect their rights as de facto custodians.

At the Sellers Law Firm our goal is to protect your rights as grandparents.  Whether you are seeking answers about a guardianship, custody, or visitation, we are here to guide you.  Give us a call at 770-415-9848 at the Sellers Law Firm: Where Clients Become Family.

New Laws Take Effect July 1

With July 1 of the new year having come and gone, it is that time of year when Georgia’s new laws start taking effect.

Along with updates to banned contraband in Georgia jails/prisons (which now includes the prohibition of all tobacco products) [see Senate Bill 149] as well as new regulations for municipal probation officers [see Senate Bill 149], Georgia’s new laws run the gambit.

Be sure to stay informed with these and other updates.  You can check out the new laws verbatim by checking out the Georgia legislative list HERE.

How to Beat a Radar Enforced DUI/Traffic Stop

Jody Louis Sellers of Griffin, Georgia recently received advanced level training, from the American Association of Premier DUI Attorneys, on How to Beat a Radar Enforced DUI/Traffic Stop. Jody received training on how to try the radar machine.  The training included Pre-trial Motions, Jury Selection, Opening Statement, the Testimony of the Peace Officer, Cross-Examination, where to incorporate 3 drawings, and the Closing Argument. This training was developed by George Long, an Executive Member of the Association, whose office is located in Odessa, Texas.

The American Association of Premier DUI Attorneys has compiled information from Judges, Traffic Safety Resource Prosecutors (the Top DUI Prosecutors in each State), DUI Prosecutors, current Law Enforcement Officers, former Law Enforcement Officers, and DUI Defense Attorneys to determine exactly what skills, knowledge, training, tools, resources, and strategies win the most DUI cases at trial and are also used to get DUI cases successfully resolved for the defense prior to trial.

When people need a DUI Attorney, the biggest challenge is knowing whether or not an attorney truly has the skills, knowledge, training, tools, resources, and strategies that are needed to successfully resolve and win DUI cases. Countless attorneys handle DUI cases. But, only a very small percentage have the skills, knowledge, training, tools, resources, and strategies that are needed to successfully resolve and win DUI cases.

License Suspensions: Why You Should Not “Just Pay the Ticket”

license suspension

A license suspension can be triggered by a number of different traffic and criminal convictions: DUI, Reckless Driving (for Commercial Drivers and Under-21 Drivers), No Proof of Insurance, Hit & Run, and Driving on a Suspended License, to name a few.  Often people find themselves trudging down to the court house to just pay the fine and walk away, only to find out later that their license has been suspended.

When facing a traffic ticket or criminal charge that could suspend your license, you do not need to take a risk and walk into court alone.  Whether the ticket your facing may add points to your license or suspend your license all together, you need to be informed and represented before you step foot into court.

As laid out on the website for the Georgia Department of Driver Services, there are three ways that you can lose your right to drive:

  1. Cancellation: “The Department of Driver Services is authorized to cancel your driver’s license if you fail to give the required or correct information needed in your application or if you are otherwise ineligible.”
  2. Revocation: “When your driver’s license is revoked, your driving privileges are terminated and withdrawn until the end of the period of time prescribed by the formal action of the DDS. At the expiration of the revocation period, you may apply for a new driver’s license once you satisfy the requirements. You will be required to re-take the driving tests.”
  3. Suspension: “When your driver’s license is suspended, your driving privilege is temporarily withdrawn for a specific period of time. At the expiration of the suspension period, you may apply for a driver’s license once you satisfy the requirements.”

For anyone looking for a few quick FAQs on license suspensions in Georgia, you can check out the Georgia Department of Driver Services here.

2017 Georgia Legal Food Frenzy Begins April 17

The Sellers Law Firm, LLC, is proud to begin participating this year (our first year of business) in a great tradition : participating annually in the Georgia Legal Food Frenzy to generate food donations for our region!

From Patrick O’Conner/State Bar President: “The 6th Annual Legal Food Frenzy food and fund drive competition kicks off April 17 and runs through April 28. Already, hundreds of firms and legal organizations in Georgia have signed on to raise food and funds for their regional food bank during this friendly two-week competition.

Don’t be left out! Register your firm or organization at galegalfoodfrenzy.org/sign-up!

Not only is the Food Frenzy a fun way to go head-to-head with your fiercest rivals outside of the courtroom, it also could not be for a more important cause. We all know we would do anything for our children, but 1 in 4 kids in Georgia are at risk for hunger and this becomes more severe over the summer months. Who is at their best when they are hungry?

When you donate to your food bank, you are making a real difference in the lives of the children and families they serve. For every $1 donated, the food banks can on average put $8 worth of groceries back into the community. That is real impact. ”

If you’re interested in donating, donations can be delivered to our law firm’s office at 100 South Hill Street, Suite 502, Griffin, Georgia 30223, beginning on April 17, 2017.

*DONATIONS ACCEPTED:

Collecting Non-Perishable Food

Most needed food items are Peanut Butter, Canned Tuna, Canned Beans, Canned Soups, Stews, Pastas, 100% Fruit Juice, Canned Fruits, Vegetables, Macaroni and Cheese Dinners, Whole Grains, Low Sugar Cereals (boxed).

Candy will not be counted.

Please don’t donate food items in glass containers – they have a high risk of breaking.

Please do not open items that are already packed in cases, cartons, or boxes. This will make it easier for the Food Bank to pick up.

All food donations will be donated to a local food bank in our region, as designated by the State Bar of Georgia

Check out our Facebook event page for more information or the State Bar Page here.

Field Sobriety Tests: An Introduction for Beginners

Being pulled over and asked to step out of the car is one of the scariest moments you can face as a driver–taking Field Sobriety Tests can be even scarier.  Often these requests to vacate your vehicle by law enforcement are for one purpose–to arrest you for a D.U.I.  Whether you have been drinking or not, the exercises used by law enforcement (called Standard Field Sobriety Tests, or SFSTs/FSTs) to determine whether they believe you are under the influence can be failed whether you are sober or not.  If you find yourself facing a DUI arrest or you are curious about how these “tests” work, give us a call at 770-415-9848 to discuss your case at the Sellers Law Firm: Where Clients Become Family.

Restoring Your Gun Rights 101: An Introduction for Beginners

A felony criminal record changes your life forever, including your gun rights.  One of the ways your life is changed is the loss of your Constitutional Second Amendment right to carry, possess, and transport firearms.  Under Georgia law, however, you can have your firearm rights restored if certain conditions are met.  Restoring your rights is never a guarantee, the process can be long and tedious, and the technical criteria you have to meet can often be confusing.  At the Sellers Law Firm we have years of experience in helping clients restore their constitutional right to bear arms.  Give us a call today to discuss restoring your rights at the Sellers Law Firm: where clients be come family.

Compassion Matters

Compassionate Griffin Georgia Family Law Attorney

At the Sellers Law Firm we strive to ensure you experience one specific thing when you use our firm: compassion.  Whether you are dealing with a custody case, child support case,  divorce case, or legitimation case you need someone who cares in your corner.  You never “win” a domestic case because unfortunately someone is usually still hurting at the end of the day.  When you have an attorney who honestly cares about you and your case, at least you know that you are not dealing with this difficult reality alone.

At the same time, if you are experiencing a DUI arrest, dealing with a traffic ticket, or facing a misdemeanor or felony, you need help and guidance from someone who truly cares.  This one instance with the criminal justice system will impact your life for better or worse, and you deserve someone who cares fighting for you.

If you want to know more about our firm, please feel free to check us out on social media or learn more about us through others and what they have to say.

Once you have done that, let us put our experience to work for you. We look forward to making you a part of our family. Give us a call at 770-415-9848 at the Sellers Law Firm: Where Clients Become Family.
