D.U.I. Law Changes in Georgia: 10-Day Letter becomes 30-Day Letter

House Bill 205 has added a few more details to the state’s current D.U.I. laws, and with those changes comes the need to update and education ourselves.

In addition to a new Ignition Interlock Permit option for certain individuals charged with a D.U.I., see our article HERE, the traditional ten (10) day period in which a driver has to appeal a license suspension under a DS-1205 Form has increased to thirty (30) days.

Prior to July 1, 2017, anyone charged with a D.U.I. and issued a DS-1205 Form suspending their license (known as an administrative license suspension, ALS), would receive a temporary driving permit for thirty (30) days.  If you failed to appeal this suspension within ten (10) days, your license would automatically be suspended.

With the passage of House Bill 205, however, that time period has now been extended to thirty (30) days.  Often called a 10-Day letter, with this new law we now have to become accustom to 30-Day letters.

Buyer Beware: New D.U.I. Interlock Permit Law

On July 1, 2017, House Bill 205 became effective, offering individuals charged with a D.U.I. the ability to apply for a special kind of driving permit: The Ignition Interlock Device Limited Permit.  As the Department of Driver Serices states on their press release,

                  Persons who have been charged with driving under the influence (DUI) in Georgia and whose Georgia driver’s license is subject to an administrative license suspension (ALS) may have the option beginning July 1st to obtain a new type of limited driving permit from the Georgia Department of Driver Services (DDS). 

                   The new permit, technically referred to as an “Ignition Interlock Device Limited Permit”, will be conditioned upon the person whose driver’s license is subject to an ALS voluntarily waiving his or her right to an administrative hearing and having an ignition interlock device installed on any vehicle they intend to drive.  The current ALS process, including the right to an administrative hearing, will remain in place as an option for persons whose driver’s license is subject to an ALS and either do not qualify for or do not wish to obtain the new permit.  Click HERE for the full press release.

Unfortunately,  this statute has been misinterpreted and some companies have been instructing individuals that this is required for them to retain their driving privileges.

As always, stay informed and know your rights.  This is an OPTIONAL alternative for individuals wishing to waive their A.L.S. hearing.

New Laws Take Effect July 1

With July 1 of the new year having come and gone, it is that time of year when Georgia’s new laws start taking effect.

Along with updates to banned contraband in Georgia jails/prisons (which now includes the prohibition of all tobacco products) [see Senate Bill 149] as well as new regulations for municipal probation officers [see Senate Bill 149], Georgia’s new laws run the gambit.

How to Beat a Radar Enforced DUI/Traffic Stop

Jody Louis Sellers of Griffin, Georgia recently received advanced level training, from the American Association of Premier DUI Attorneys, on How to Beat a Radar Enforced DUI/Traffic Stop. Jody received training on how to try the radar machine.  The training included Pre-trial Motions, Jury Selection, Opening Statement, the Testimony of the Peace Officer, Cross-Examination, where to incorporate 3 drawings, and the Closing Argument. This training was developed by George Long, an Executive Member of the Association, whose office is located in Odessa, Texas.

The American Association of Premier DUI Attorneys has compiled information from Judges, Traffic Safety Resource Prosecutors (the Top DUI Prosecutors in each State), DUI Prosecutors, current Law Enforcement Officers, former Law Enforcement Officers, and DUI Defense Attorneys to determine exactly what skills, knowledge, training, tools, resources, and strategies win the most DUI cases at trial and are also used to get DUI cases successfully resolved for the defense prior to trial.

License Suspensions: Why You Should Not “Just Pay the Ticket”

A license suspension can be triggered by a number of different traffic and criminal convictions: DUI, Reckless Driving (for Commercial Drivers and Under-21 Drivers), No Proof of Insurance, Hit & Run, and Driving on a Suspended License, to name a few.  Often people find themselves trudging down to the court house to just pay the fine and walk away, only to find out later that their license has been suspended.

When facing a traffic ticket or criminal charge that could suspend your license, you do not need to take a risk and walk into court alone.  Whether the ticket your facing may add points to your license or suspend your license all together, you need to be informed and represented before you step foot into court.

As laid out on the website for the Georgia Department of Driver Services, there are three ways that you can lose your right to drive:

  1. Cancellation: “The Department of Driver Services is authorized to cancel your driver’s license if you fail to give the required or correct information needed in your application or if you are otherwise ineligible.”
  2. Revocation: “When your driver’s license is revoked, your driving privileges are terminated and withdrawn until the end of the period of time prescribed by the formal action of the DDS. At the expiration of the revocation period, you may apply for a new driver’s license once you satisfy the requirements. You will be required to re-take the driving tests.”
  3. Suspension: “When your driver’s license is suspended, your driving privilege is temporarily withdrawn for a specific period of time. At the expiration of the suspension period, you may apply for a driver’s license once you satisfy the requirements.”

SCAA’s Annual Colors of Cancer Raffle

The Spalding County Athletic Association’ s (SCAA) Annual Colors of Cancer fundraising raffle is back!

This April 29, 2017, marks the start of the SCAA Colors of Cancer Raffle. Money raised on this day will go to Cancer Warriors of Spalding County to help families dealing with cancer in our local community.

Farm to Table: A New Griffin Tradition

 

On Saturday, April 29, 2017, the Griffin Downtown Council is hosting its first ever Farm to Table Dinner on the 6th Street Bridge in downtown Griffin, Georgia. The 6th Street Bridge will be lined with locally handcrafted farmhouse tables to create a dinner full of rustic southern ambiance.  With local food provided by local farmers, Griffin will be hosting a truly remarkable event to showcase the beauty of the community.  Meals will be prepared by local chefs, making this event truly a showcase of Griffin’s passion and unique offerings.

Enjoy an evening of dinner, drinks, music and more on one of Downtown Griffin’s most famous landmarks–the 6th Street Bridge. Your ticket purchase will include a 4 course farm to table style meal atop the 6th Street Bridge. Diners will experience a diverse menu that will highlight what is in season from local growers and farmers. All proceeds will support your local downtown community.

2017 Georgia Legal Food Frenzy Begins April 17

The Sellers Law Firm, LLC, is proud to begin participating this year (our first year of business) in a great tradition : participating annually in the Georgia Legal Food Frenzy to generate food donations for our region!

From Patrick O’Conner/State Bar President: “The 6th Annual Legal Food Frenzy food and fund drive competition kicks off April 17 and runs through April 28. Already, hundreds of firms and legal organizations in Georgia have signed on to raise food and funds for their regional food bank during this friendly two-week competition.

Not only is the Food Frenzy a fun way to go head-to-head with your fiercest rivals outside of the courtroom, it also could not be for a more important cause. We all know we would do anything for our children, but 1 in 4 kids in Georgia are at risk for hunger and this becomes more severe over the summer months. Who is at their best when they are hungry?

When you donate to your food bank, you are making a real difference in the lives of the children and families they serve. For every $1 donated, the food banks can on average put $8 worth of groceries back into the community. That is real impact. ”

Candy will not be counted.

Please don’t donate food items in glass containers – they have a high risk of breaking.

Please do not open items that are already packed in cases, cartons, or boxes. This will make it easier for the Food Bank to pick up.

All food donations will be donated to a local food bank in our region, as designated by the State Bar of Georgia

Business at the Tee in Griffin

The Griffin-Spalding Chamber of Commerce is hosting its annual Business at the Tee event this Monday, April 10, 2017.  As a business expo, this great event is used to raise funds for the Chamber, while simultaneously promoting local businesses by allowing the community and businesses to interact in a fun setting–golf!

This year’s event is being held at the Sun City Golf Course in Griffin, Georgia.  Starting at 9:00 a.m., the event will conclude later in the afternoon.

New Advanced Level Training on Getting a Drug Recognition Expert (DRE) Case Dismissed Using DRE’s Rolling Log

Jody Louis Sellers of Griffin, Georgia, recently received advanced level training, from the American Association of Premier DUI Attorneys on “How to Get a Drug Recognition Expert (DRE) Case Dismissed Using the DRE’s Rolling Log.”  Jody received training about the international standards that are required for a DRE to be able to renew certification as a DRE.  Additionally, he received training on how to read a DRE’s Rolling Log, as well as how to get a case dismissed by showing that the DRE is actually not a certified DRE.

Field Sobriety Tests: An Introduction for Beginners
