THIRTY (30) DAYS TO APPEAL
Upon an individual’s arrest for Driving Under the Influence (DUI) pursuant to O.C.G.A. § 40-6-391, they are subject to having their license suspended by the Department of Drivers Services (DDS). You are required to receive notice of this license suspension, and notice is given by receiving from the law enforcement officer a DDS-1205 form (1205).
If an officer issues a 1205 to you, you have thirty (30) days from the date of your arrest to file an appeal of that suspension. During this appeal period, your license will not be suspended.
